The history of corporate technology governance is littered with policies that were written carefully, reviewed thoroughly, approved formally, and then ignored completely. AI governance is at serious risk of repeating this pattern—and the stakes are considerably higher.

As boards and regulators push organizations to demonstrate AI governance, many are responding by producing policies. The policies are typically comprehensive. They cover model risk, data privacy, bias and fairness, human oversight, and vendor management. They are, in many cases, well-researched documents that reflect genuine thinking about AI risk.

They are also, in many cases, documents that will have no meaningful impact on how AI is actually used in the organization. Because governance that is not embedded in how people actually work is not governance. It is documentation.

Why AI Policies Fail

Most AI policies fail for one of three reasons. The first is that they are written by legal and compliance functions without sufficient input from the people who actually build and deploy AI. These policies correctly identify the risks but prescribe controls that are technically infeasible or operationally impractical. Engineers route around them. Not out of malice—out of necessity.

The second failure mode is that policies attempt to govern all AI use with a single framework. A policy that applies the same oversight requirements to a customer service chatbot and a clinical decision support system will either over-restrict the former or under-restrict the latter. Risk-proportionate governance requires different standards for different risk levels—and most organizations have not done the work to tier their AI use cases by risk before writing their policy.

The third failure mode is that policies focus on prohibition rather than enablement. They tell employees what they cannot do with AI. They do not tell them what they should do when they want to use AI responsibly, who to consult when they are uncertain, or what the process is for getting a new AI use case approved. Prohibition without process creates a choice between noncompliance and paralysis. Most people choose noncompliance.

What Good AI Governance Looks Like

Effective AI governance starts with a risk taxonomy—a structured classification of AI use cases by their potential for harm. A simple three-tier system works well for most organizations: low-risk use cases that can proceed with standard data privacy controls, medium-risk use cases that require designated review and documented oversight mechanisms, and high-risk use cases that require formal validation, ongoing monitoring, and explicit senior approval.

The taxonomy does two important things. It focuses governance resources where the actual risk is. And it creates a clear, fast path for low-risk use cases—which is where most of the day-to-day AI use happens. Employees who experience AI governance as primarily an enabler of responsible use rather than primarily an obstacle will comply with it. Employees who experience it as a bureaucratic obstacle will route around it.

Good AI governance also requires clear ownership. Someone needs to be accountable for the AI governance framework—not as a compliance function, but as an operational one. This person needs the authority to make calls quickly, the technical credibility to be taken seriously by engineering teams, and the business judgment to know when governance requirements should evolve in response to new technology or new risk.

The Enablement Principle

The most effective AI governance frameworks are built on what we call the enablement principle: the primary purpose of AI governance is to help the organization move faster with AI, safely—not to slow it down.

This framing changes how policies are written, who is involved in writing them, and how they are communicated. Policies built on the enablement principle include clear decision rights and escalation paths. They provide checklists and templates that make compliance easier than noncompliance. They identify the responsible owners employees should contact when they are uncertain—and they ensure those owners are responsive.

The test of whether your AI governance framework is built on the enablement principle is simple: ask an engineer or a product manager whether the governance framework makes their job easier or harder. If the honest answer is harder, you have documentation, not governance.

Getting Started

Organizations that do not yet have formal AI governance should resist the temptation to start by writing a comprehensive policy. Start by doing an inventory of AI use cases already in production or under development. Classify them by risk level. Identify the highest-risk ones and implement proportionate controls for those first. Then build the broader framework from that foundation.

This approach produces governance that is grounded in organizational reality rather than theoretical risk. It is also significantly faster to implement—which matters, because most organizations have AI already deployed in ways that are not yet governed. Starting with what exists, rather than trying to build the perfect framework before doing anything, produces faster and more durable results.
